Do I have to go to court?

In a word: No. You do not have to go to court to file bankruptcy.

Sometimes a debtor's worst nightmare is the imaginary scenario of having to appear in court after filing bankruptcy. The idea of testifying before a judge strikes fear in the hearts of many people who are at a very low financial point in life. They worry that they will become nervous and commit some serious mistake, ruining any chances of obtaining debt relief through bankruptcy. They also worry about feeling ashamed, or being accused of wrongdoing in connection with their unpaid debt or their bankruptcy filing.

What to Expect at the 341 Creditors' Meeting

In practice, however, very few debtors ever appear in bankruptcy court. Rather, a debtor and his or her lawyer attend a 341 creditors' meeting before a trustee a month or so after the debtor files bankruptcy. These meetings are usually low key and uneventful. In an ordinary meeting room, dozens of debtors and their attorneys may be awaiting their turns to answer questions of the trustee, one by one. Each debtor's meeting typically lasts only a few minutes. Although the 341 meeting is called a "creditors' meeting," creditors almost never attend. There is no judge, no courtroom and usually no further obstacle to debt relief by the time you reach the point of the 341 creditors' meeting.
